DISPLACEMENT AND REHABILITATION IN NEPAL
ANANDA MOHAN BHATTARAI
Though there is no dearth of books on involuntary displacement, a great many of them highlight the sociological and anthropological aspect of the issue. Here is an author who takes a legal stand, and on the basis of the constitutional provisions of Nepal and international human rights and environmental norms, argues that project affected persons (PAPs) do possess a right not to be arbitrarily displaced. The book analyses the normative and institutional framework of several South Asian countries including India, Pakistan, Bangladesh, Sri Lanka, Maldives and Bhutan on acquisition of property and resettlement. The examination of state practices of China and India on resettlement and rehabilitation and the policy of international financial institutions like the World Bank and OECD form important part of the book. After conducting an in-depth study of the displacement issue of two projects of Nepal the author comes to the conclusion that where displacement results as a legal consequence leaving resettlement and rehabilitation to executive mercy would be a worse antidote. With a view to check this he advances a legislative solution, and presents an outline of draft legislation on acquisition resettlement and rehabilitation. It is our firm belief that the book will be of immense benefit to policymakers, academics, activists and students who are interested on the subject in their respective capacities.
